    The law on Italian citizenship (Law n. 91/92) has recently undergone a substantial change.

    With the conversion of Decree-Law 36/2025 into Law 74/2025, the requirements for recognition of Italian citizenship by descent are now significantly stricter than they have been at any point in the last 150 years.

    While legal debates are ongoing, we are currently in a period of legal uncertainty.

    Some clarity is expected once definitive decisions are issued by the Constitutional Court and the Supreme Court of Cassation.

    Constitutional Court:

    The Italian Constitutional Court is currently reviewing several aspects of Law 74/2025. The main focus of the discussion is whether the stricter requirements of Law 74/2025 can legally apply to individuals born before its enactment, specifically those who were already citizens but had not yet sought formal recognition.

    • Supreme Court of Cassation:

    Its United Sections are set to issue a landmark ruling on the so-called “Minor Issue” (concerning lineages where parents naturalized while their children were still minors).
